The City of Los Angeles has proposed the most restrictive Spay/Neuter ordinance to ever be introduced in the United States and it is only with YOUR HELP that we will be able to defeat it.

Among it worst points are:

  • $100 license fee for any unaltered dog/cat over the age of 4 months.

  • $200 annual Breeder’s Permit for each and every unaltered dog/cat licensed as unaltered regardless of age.

  • One litter per household per year.

  • If you sell. Barter, trade or give away a dog or cat you must provide the Dept. of Animal Services with:

      Name
      Address
      Telephone Number

    of the person receiving the dog/cat.

  • Dog/cat ownership is defined as "Anyone who harbors, keeps or provides sustenance to a domestic animal for 15 consecutive days."

  • A violation of this ordinance is a misdemeanor punishable by 6 months in jail and up to $1,000 in fines.

 

This is NO JOKE. The Animal Right’s Advocates have the Dept. of Animal Services Manager in their corner. Only your VOICES will make the difference. People of LA Present Ordinance Amending Section 53.00 of the Los Angeles Municipal Code Spay/Neuter Ordinance

An Ordinance amending Section 53.00 of the Los Angeles Municipal Code, to define animal ownership, and Section 53-15.2 of the Los Angeles Municipal Code, to provide for the regulation of the breeding and sale of dogs and cats, and repealing 53.15.3 of the Los Angeles Municipal Code.

THE PEOPLE OF THE CITY OF LOS ANGELES DO ORDAIN AS FOLLOWS:

Section I - Section 53-00 of the Los Angeles Municipal Code is hereby amended to insert the following definition after Animal and before Board to read,

SEC 53.00.:

Animal Owner shall mean any person harboring, keeping or providing care or sustenance to a domestic animal for 15 or more consecutive days. Such a person shall be subject to the requirements of this chapter. This Section does not apply to government agencies, non-profitt animal rescue organizations exempt from taxation under Internal Revenue Code Section 501(c)(3), or humane societies or societies for the prevention of cruelty to animals if such societies are incorporated under the provisions of California Corporations Code Section 10400 and the Nonprofit Public Benefit Corporation Law in Part 2 of the California Corporations Code, beginning at Section 5110.

Sec. 2. Section 53.15.2 of the Los Angeles Municipal Code is hereby amended to read-.

SEC. 53.15.2. BREEDING AND SALE OF DOGS AND CATS:

The City Council finds that the City of Los Angeles is facing a public health and safety crisis due to the numerous stray, injured, and/or vicious dogs roaming the City streets. T'he numerous stray cats also roaming the City streets compound this crisis. One reason for this crisis is the existing animal overpopulation in the City, which is due to unaltered dogs' and cats' ability to reproduce quickly. Another reason is the practice of many of the City's animal owners to abandon unwanted cats and dogs to fend for themselves on the streets. The Council finds that part of the solution to the problem is to require the owners of dogs and cats in the City to spay and neuter their animals as a condition of obtaining licenses to keep these animals within the City's limits. If the owner chooses not to spay or neuter his/her cat or dog,, then that owner should be required to obtain an unaltered animal permit and a breeder's permit in addition to existing licenses and permits. In addition, tighter regulation of the sales of dogs and cats will help alleviate the overcrowding crisis by allowing tighter City control over the transfer of dogs and cats. This approach was found to be effective in reducing the number of stray animals impounded by other California cities.

(a) Unaltered Animal Permit-

  1. No person shall own, harbor or keep within the City of Los Angeles a dog or a cat over the age of four months which has not been spayed or neutered, unless such person holds a valid unaltered animal permit. The term unaltered animal permit means a written authorization, issued annually by the General Manager, giving its lawful holder permission to maintain an unaltered dog or cat.

  2. Each unaltered animal permit shall be valid for one year from the date of issuance and may be renewed annually before its expiration date. Each applicant for such a permit shall pay an annual fee of $100.00. A separate permit must be obtained for each owned, unaltered animal.

  3. The following animals are exempt from the unaltered animal permit

      A. Dogs documented as having been appropriately trained and actively used by law enforcement agencies for law enforcement and rescue activities.

      B. Dogs documented as having been defined under California Penal Code Section 365.5(d),(e)&(f) as guide, signal, or service dogs.,

      C. Dogs and cats documented and certified by a licensed veterinarian as not being proper subjects for spaying and neutering due to health reasons;

      D. Dogs and cats under the care of a government animal control agency, non-profit animal rescue organization exempt from taxation under Internal Revenue Code Section 5Ol(c)(3), or humane societies or societies for the prevention of cruelty to animals, if such societies arc incorporated under the previsions of California Corporations Code Section 10400 and the Nonprofit Public Benefit Corporation Law in Part 2 of the California Corporations Code, beginning at Section 5110.

  4. The Department shall administer an unaltered animal permit program to allow ownership of unaltered dogs and cats consistent with criteria and according to Procedures established by the General Manager pursuant to Section 53.58 of this Code. Under no circumstances shall a permit be issued to a person who has been convicted of animal cruelty or neglect.

 

(b) Breeding Permit'

  1. No person shall cause or allow any dog or cat owned, harbored, or kept within the City of Los Angeles to breed without first obtaining an unaltered animal permit, as described in subsection (a) of this Section, and a breeding permit, as described below. The term breeding permit means a written authorization, issued annually by the General Manager giving its lawful holder permission to breed a dog or cat.

  2. Each breeding permit shall be valid for one year from the date of issuance and may be renewed annually before its expiration date. Each applicant for such a permit shall pay an annual fee of $200.00. A separate permit must be obtained for each owned dog or cat which is allowed to breed.

  3. The Department shall administer an animal breeding permit program to allow the breeding of unaltered dogs and cats consistent with criteria and according to established by the Genera; Manager pursuant to Section 53.58 of this Code. Under no circumstances shall such a permit be issued to a person who has been convicted of animal cruelty or neglect.

  4. In addition to the criteria and procedures established by the General Manager pursuant to paragraph 3 of this subsection, all breeding permits shall contain the following terms and conditions:

      A. The owner of an unaltered dog or cat shall not allow the whelping of more than one litter in any household within the permit year. Notwithstanding this provision, the General Manager is hereby authorized, upon application of a permittee, to allow, on a one-time basis, the whelping of up to two dog or cat litters per animal within any domestic, household within a permit year, if the permittee establishes, according to regulations promulgated by the General Manager, that such breeding is required to protect the health of the animal or avert a substantial economic loss to the permittee. In the event that a permittee is forced to euthanize a litter of dogs or cats, the General Manager may authorize the whelping of one additional litter of dogs or cats within the same permit year by permittee.

      B. No offspring may be sold, adopted, bartered. or otherwise transferred whether for compensation or otherwise, until it has reached the age of at least might (8) weeks;

      C. No offspring may be sold or adopted until immunized against common diseases. The sale or adoption of a dog or cats shall include a statement signed by the seller or adopter attesting to signatory's knowledge of the animal's health, and the animal's immunization history;

      D. Any holder of a breeding permit who advertises to the public the availability of any dog or cat for sale, adoption, or transfer, whether for compensation or otherwise, must prominently display the permit number in any such advertisement. Further, the breeding permit holder must provide the permit number to any person who purchases, adopts, of receives any animal from the permit holder-,

      E. Commercial establishments selling locally bred dogs or cats shall prominently display the breeding permit number(s) of the breeder(s) whose dogs and cats are sold in said establishments;

      F. Any breeding permit holder selling or otherwise transferring a dog or a cat, whether for compensation or otherwise, shall submit to the Los Angeles Department of Animal Regulation the name, address, and telephone number of the animal's new owner within five days from the sale or other transfer; and

      G. Any breeding permit holder or commercial establishment which sells or otherwise transfers a dog or cat, whether for compensation or otherwise, shall provide to the now animal owner written information regarding the license and permit requirements of the City of Los Angeles :applicable to such animal.

 

(c) Sale, Adoption, -and Other Transfers of dogs and Cats:

  1. Any person who offers or provides, whether for compensation or otherwise, any dog or cat, shall disclose to the transferee information regarding the license and permit requirements of the City of Los Angeles applicable to the transferred animal.

  2. No person shall present any dog or cat for sale, adoption, batter, exchange, or adoption, whether for compensation or otherwise, in any public place, without first obtaining a permit pursuant to Los Angeles Municipal Code, Section 53.50. The term public place shall include, but not be limited to: streets, highways, carnivals, shopping malls, flea markets, boardwalks, and areas in front of commercial establishments. This prohibition shall not apply to:

      A. Government agencies, non-profit animal rescue organizations exempt from taxation trader Internal Revenue Code Section 501(c)(3), or humane societies or societies for the prevention of cruelty to animals, if such societies are incorporated under the provisions of California Corporations Code Section 10400 and the Nonprofit Public Benefit Corporation Law in Part 2 of the California Corporations Code, beginning at Section 5110;

      B. Permitted dog or cat shows; or

      C. Permitted pet stores which sell or otherwise transfer dogs or cats, whether for compensation or otherwise, within the store.

  3. No person shall give away any dog or cat as a prize or as an inducement to enter into any contest, lottery, drawing,. game, or competition,

  4. No person shall give away any dog or cat as an inducement to enter a place of business or to enter into a business arrangement.

  5. No person shall sell, barter, exchange, or offer for adoption, whether for compensation or otherwise, any dog or cat to any minor under the age of eighteen year, without the written permission of one of the minor's parent or legal guardians,

 

(d) Penalties:

  1. Except as provided herein, any person violating any provision of this Section is guilty of a misdemeanor. Any owner of unaltered dog(s) or cat(s) without unaltered permit(s) and/or breeding permit(s), as required by this Section, may correct the violation(s) by providing conclusive proof to the Department that the dog(s) or cat(s) have been spayed or neutered, or by obtaining the necessary permits mentioned in this Section, no later than thirty (30) days after the date when the Department had notified the owner of the violation. The fees imposed to correct these violations shall be as stated in subsections (a)(2) and (b)(2) above, and a penalty shall be added thereto in an amount equal to 100 percent (100%) of said fees.

  2. Any holder of a permit issued pursuant to this Section, who is found to be in violation of the terms and conditions of the permit may have such permit revoked by the Department following an Administrative hearing. The hearing shall be conducted pursuant to the provisions of Section 53.18.5 of the Code; provided however that a finding such violation by the Department's hearing examiner, if sustained by the General manager, shall result in the permit(s) revocation notwithstanding the provisions of Section53.18.5(1) of this Code

(e) Distribution of permit fees:

An amount equal to fifty percent (50%) of the permit fees and penalties collected pursuant to this Section -shall be deposited directly in the Animal Spay and Neuter Trust Fund, which was created pursuant to Section 5.201 of the Los Angeles Administrative Code.

Sec. 3. Section 53.15.3 of the Los Angeles Municipal Code is hereby repealed.

Sec. 4. The City Clerk shall certify to the passage of this ordinance and cause the same to be published in some daily newspaper printed and published in the City of Los Angeles.

CITY OF LOS ANGELES: Following the abrupt adjournment due to the overflow crowd of the August 25 public meeting on the proposal to require spay/neuter of all dogs and cats over 4 months without $100 unaltered permit, increase the existing breeder permit from $50 to $200, the L.A. Department went back to the drawing board to find locations large enough to accommodate hundreds of people and vehicles. The new schedule announced at 5:30 this afternoon is:

    The ordinance supporters have reacted to the large turnout of opponents and high profile alerts on The American Kennel Club web site by stepping up their own efforts to turn out larger numbers of supporters. Ordinance opponents must keep up the pressure, as momentum is faltering. Please spread the word!

    RIVERSIDE COUNTY has also been considering unfavorable ordinance changes, but a hearing scheduled this week was cancelled and we are developing more information. A major point would be to increase the offense level for violation of the 4-dog limit from infraction to misdemeanor. Also in Riverside County is the ongoing saga of colorful character and dedicated Dalmatian rescuer, Randy Warner (see People Magazine, 4/20/98) who is being prosecuted on yet another infraction limit law violation after conviction in August on the last charge.
